1. Introduction

Welcome to Rapid Alert USA, an application operated by NDS Solutions Ltd (“Rapid Alert,” “we,” “our,” or “us”).
By accessing or using the Rapid Alert app or related services (“the App”), you agree to comply with and be bound by these Terms of Service (“Terms”).
Please read these Terms carefully before using our App.

2. Acceptance of Terms

By creating an account or using any part of our services, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the App.

3. Eligibility and Use of the App

  • You must be at least 13 years old to use the App.
  • Parents, guardians, or authorized organizations (e.g., law enforcement, care homes, schools) may register information about children under 13 for the sole purpose of safeguarding or issuing missing-person alerts.
  • You agree to use the App lawfully, ethically, and for its intended purpose only.
  • You must not misuse, disrupt, or interfere with the App or its servers.
  • We reserve the right to suspend or terminate access for violations of these Terms.

4. Account Responsibilities

You agree to:

  • Provide accurate, current, and complete information when creating an account.
  • Maintain the confidentiality of your login credentials and prevent unauthorized access.
  • Notify us immediately of any security breach or unauthorized account use.

You are responsible for all actions taken through your account.

5. Content and Intellectual Property

All content and materials on the App — including text, graphics, software, and trademarks — are owned by or licensed to NDS Solutions Ltd and protected by U.S. and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for lawful personal or organizational purposes.

You may not reproduce, distribute, modify, or create derivative works without explicit written permission.

6. User-Generated Content

You are responsible for all content (including images, text, and data) that you upload or share through the App.
By submitting content, you confirm that:

  • You own or have legal permission to share the content.
  • The content does not infringe the rights of others or violate any applicable laws.
  • The information is accurate and shared for the legitimate purpose of assisting with missing or vulnerable person alerts.

We may remove or modify any user-generated content that violates these Terms or is otherwise deemed inappropriate.

7. User Responsibilities for Sensitive Information

By uploading personal details or images of individuals, you agree that:

  • You have obtained explicit permission or legal authority to share such information.
  • The content is intended solely to help locate or safeguard missing or vulnerable individuals.
  • You will not use the App to share or distribute sensitive data for any unrelated purpose.

Rapid Alert USA reserves the right to suspend accounts or remove content found to be in violation of these conditions and may refer such cases to law enforcement.

8. Prohibited Uses

You may not:

  • Upload, share, or distribute personal images or data without authorization.
  • Use the platform to harass, intimidate, mislead, or deceive others.
  • Submit false or malicious reports.
  • Engage in conduct that violates any law or infringes on the privacy or safety of others.

Any misuse of the App may result in immediate suspension and referral to relevant authorities.

9. WhatsApp and Communication Consent

By creating an account and accepting these Terms, you consent to receive service notifications from Rapid Alert USA via WhatsApp, email, or SMS, including:

  • Missing person alerts in your area
  • Account-related updates and important service messages

You can opt out of WhatsApp notifications at any time by replying “STOP.”

10. Third-Party Links and Integrations

The App may include third-party links, APIs, or integrations (e.g., Meta, WhatsApp, Twitter/X, or Instagram).
We are not responsible for the accuracy, safety, or privacy practices of third-party platforms.
Your interaction with these services is governed by their respective terms and policies.

11. Limitation of Liability

To the fullest extent permitted by law, NDS Solutions Ltd, its officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • Use or inability to use the App
  • Unauthorized access or alteration of your data
  • Any actions or content posted by other users

Our total liability shall not exceed the amount you paid (if any) for using the App.

12. Indemnification

You agree to indemnify and hold harmless NDS Solutions Ltd, its officers, employees, and agents from any claims, damages, or expenses resulting from:

  • Your violation of these Terms
  • Your misuse of the App or content posted within it

13. Content Removal and Reporting

If you believe content on Rapid Alert USA infringes upon your privacy, intellectual property, or is otherwise inappropriate, please contact us at support@rapidalertusa.com.
We will review and respond to all complaints within 48 hours, removing or restricting content where appropriate.

14. Termination

We reserve the right to suspend or terminate your account or access to the App at any time, without notice, if you violate these Terms or engage in harmful behavior.
You may also delete your account at any time by contacting us.

15. Changes to These Terms

We may update or modify these Terms periodically.
Any changes will be posted on our website with an updated revision date.
Your continued use of the App after such updates constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California, USA.
